How Can a Baby Die at Birth?

Though relatively rare in the United States, infant death (neonatal death) and stillbirths are not altogether uncommon. When a baby dies in the womb at any point between 20 weeks of pregnancy and the baby’s due date, this is known as stillbirth. When a baby dies within his or her first 28 days of life, this is often referred to as neonatal death.

There are many reasons a baby may die prior to or during labor and birth, as well as immediately following birth. Some of the risk factors include:

  • Premature birth
  • Birth defects
  • Low birth weight

Pregnancy problems, such as maternal infection or preeclampsia, can also lead to stillbirth or neonatal death. If a mother does not receive proper treatment and care during pregnancy, leading to stillbirth or the death of her newborn, this could be an example of medical malpractice.

Not all infant deaths and stillbirths are the result of medical negligence, though many instances occur because a medical professional committed a preventable fatal mistake.

An infant’s death may be the result of medical negligence if it occurred due to:

  • Prolonged labor, leading to birth asphyxiation
  • A doctor’s failure to order a timely emergency cesarean section (C-section)
  • Delivery room staff’s failure to monitor the baby for signs of distress
  • A doctor’s failure to properly treat signs of fetal distress
  • Birth trauma, including brain injuries and spinal cord injuries
  • Medication mistakes, including incorrect medication/dosage administered to the mother

Maternal Death Due to Medical Malpractice

When doctors and other health care providers are negligent, the baby is not the only one at risk. Tragically, mothers can also die during labor and delivery when there are complications and/or the health care team fails to provide the proper standard of care.

Birth complications that could put the mother at risk include but are not limited to:

  • Maternal hemorrhaging (severe bleeding)
  • Post-birth infections
  • Preeclampsia and eclampsia (high blood pressure during pregnancy)
  • Heart problems and blood clots
  • Cesarean section (C-section) complications
  • Medication mistakes (including improperly administered epidurals)
